Both chambers of the state Legislature adopted a bill Tuesday that jettisons provisions requiring state officials to consider only historical elevations of seawater, an order pursued by the Senate that ignores scientific warnings about the future impact of rising temperatures on melting ice sheets. The newest bill allows state and local officials to consider both past and future sea-level rise when crafting land-use plans for projects like housing developments and public infrastructure. But it also delays the use of those regulations for four years, until additional research is complete. The bill is waiting for the governor's signature.
Opponents of the bill seemed to breathe a sigh of relief at the outcome, following weeks of cutting criticism between scientists and lawmakers as the issue of sea levels pivoted into a wider argument about climate change. "The bill that finally passed was a hell of a lot better than what we started out with," said Frank Tursi, assistant director of the North Carolina Coastal Federation, an environmental group. The measure establishes a moratorium on building standards and other rules that incorporate protections against rising sea levels, the current rate of which varies from 2 to 4 millimeters a year, depending on location, along the North Carolina coast. The moratorium prohibits rules using historical and future rates of sea-level rise until 2016.
Climate 'Kool-Aid'
The bill also instructs the state Coastal Resources Commission to study the physical and economic impacts of sea-level rise beginning in 2015. The current debate about rising oceans ignited in response to the commission's 2010 recommendation that the state should begin planning for a 39-inch rise by 2100. An economic development group named NC-20 led the campaign to dismantle the commission's recommendation, saying scientific estimates of future sea rise based on computer modeling are just a guess. The group encouraged conservative lawmakers to pursue legislation banning future estimates after the commission retreated from its efforts to establish the 39-inch "benchmark."
Tom Thompson, president of NC-20 and the economic development director in Beaufort County, said the bill passed this week marks a victory for North Carolina residents who refuse to drink the climate change "Kool-Aid." "Our position at NC-20 is very simple: We are not averse to science," Thompson said. "We are for science -- properly done, properly documented, properly interpreted. And quite frankly, accelerated sea-level rise does not meet that test." But scientists, and some lawmakers, disagree with Thompson. The coastal commission reviewed leading scientific studies on future sea-level rise before making its recommendation in 2010. In response, the state Senate passed a bill last month that prohibited state officials from using mainstream scientific studies predicting that oceans will rise more quickly beginning in about 2030 when creating land use plans.
World's attention is 'very distracting'
But the House balked at the Senate bill, which aimed widespread negative attention on the state during an election year. Republican state Rep. Ruth Samuelson, the majority whip, quoted a proverb when asked by email why the House deviated from the Senate bill. She suggested her chamber did not want to be "a passer-by who meddles in a quarrel not his own." Republican state Rep. Chuck McGrady said the intense fascination of national media on the Senate bill made House lawmakers uncomfortable. The attention peaked when comedian Stephen Colbert ridiculed North Carolina for trying to outlaw sea-level rise. "I don't think people like that sort of focus," said McGrady. "It's very distracting. I think cooler heads came together [in the House]." But the changes were not enough for McGrady, a former national president of the Sierra Club and perhaps the only Republican to vote against the House bill Tuesday. He opposes the four-year moratorium on regulations, which he says would help the state prepare for rising seas. "It clearly does create a restriction for the Coastal Resources Commission," he said of the House bill. "My view is let the ... commission do their job."
Environmentalists, meanwhile, say there is one upside to the attention on their state. "This negative publicity that we've had over the past month will throw a spotlight onto an issue that will be extremely important to coastal North Carolina," said Tursi, of the North Carolina Coastal Federation. "And as time goes by ... reality will force us to acknowledge what's going on."
